Since 1995 Brad Epstein has been specializing as a community association law attorney.
Mr. Epstein regularly participates in continuing education seminars as a lecturer on construction defect litigation and community association law. He is an author of published articles for community association trade organizations such as California Association of Community Managers (CACM) and the Community Associations Institute (CAI). He is an active leader, past president, and past legislative action committee co-chair in CAI's California North Chapter.
Mr. Epstein establishes long-term relationships with his clients by providing community associations with complete, clear, timely, and proactive legal services at reasonable rates.
General Counsel
Mr. Epstein provides legal services to hundreds of associations ranging in size from four residents to over fourteen thousand. Mr. Epstein represents associations in court trials, jury trials, bankruptcy hearings, fair housing mediations, administrative agency hearings, and board hearings for violating owners.
Mr. Epstein provides the following services:
Negotiating, drafting, reviewing, and interpreting contracts; Reviewing, interpreting, revising, amending, and advising on, governing documents; Attending board, committee, and member meetings, and enforcement hearings; Representation in lawsuits, administrative claims, and other legal claims; Representation in all types of disputes, including, but not limited to, fair housing complaints, mold complaints, architectural approval compliance, governing document enforcement, contractor agreements, and elections; Training board and committee members, including orientation to new members, and legal updates; Conducting annual audits of governing documents, meeting minutes, and contracts in order to attempt to ensure that they are in compliance with law and are in the best interests of the associations; and Providing advice as a measure to prevent future legal problems.
Construction Defect Claims
Mr. Epstein represents community associations and homeowners in claims for defects in the construction of common areas and homes. He has obtained construction defect claim recoveries for his clients in excess of $200,000,000. He has recovered these amounts through mediations and jury trials.
Mr. Epstein prides himself on taking efficient and effective steps to obtain recoveries that ultimately result in the associations and homeowners being able to repair the defectively constructed common areas and homes.
Mr. Epstein successfully obtains the recoveries by taking his clients through the following steps: Effectively obtaining the relevant construction documents and insurance policies covering the designers, builders, and contractors; Retaining the best forensic construction experts to perform visual and intrusive inspections; Determining the accurate scope and cost to repair the defectively constructed components; Driving the claims through the State-mandated resolution process, expeditiously without delays; and Obtaining the monetary recoveries sufficient to perform the repairs. Throughout the steps, Mr. Epstein updates his clients in real time, in laymen's terms.
